TERMS AND CONDITIONS (BIG ONE MART)

Big one Digital Pvt Ltd (“BODPL”) is the licensed owner of the brand bigonemart.com and the website bigonemart.com and its corresponding mobile web application (collectively, “bigonemart ”),. As a visitor to the Site/ Customer you are advised to please read the Term & Conditions carefully. By accessing the services provided by the Site you agree to the terms provided in this Terms & Conditions document.

These Terms of Use constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures. Please read these Terms of Use carefully before using or accessing Bigonemart or availing any Service. By using the Bigonemart or availing any Service, you signify your agreement to be bound by these Terms of Use.

1. Eligibility to Use Services

Only persons who can enter into legally binding contracts as per Indian Contract Act, 1872, i.e. persons who are 18 years of age or older, are of sound mind, and are not disqualified from entering into contracts by any law, can use and access Bigonemart. If you are a minor i.e. under the age of 18 years, you may use Bigonemart only with the involvement of a parent or guardian.

2. User Account, Password and Security.

In order to purchase the Products on the Platform, You will have to register on the Platform by providing details about Yourself, including Your name, address, contact details and such other details as may be required on the Platform and create an account (“Account”). You shall ensure and confirm that the Account information provided by You is complete, accurate and up to date. If there is any change in the Account information, you shall promptly update Your Account information on the Platform. If You provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or if TBIL has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Bigonedigital has the right to suspend or terminate Your Account and refuse any and all current or future use of the Platform (or any portion thereof) at its discretion, in addition to any right that Bigonedigital may have against You at law or in equity, for any misrepresentation of information provided by You. You will be responsible for maintaining the confidentiality of Your Account information and are fully responsible for all activities that occur under Your Account. You agree to, (a) immediately notify Bigonedigital of any unauthorized use of Your Account information or any other breach of security; and (b) ensure that You exit from Your Account at the end of each session. Bigonedigital cannot and will not be liable for any loss or damage arising from Your failure to comply with this provision. You may be held liable for losses incurred by Bigonedigital or any other user of or visitor to the Platform due to authorized or unauthorized use of Your Account as a result of Your failure in keeping Your Account information secure and confidential. Use of another User’s Account information for shopping on the Platform is expressly prohibited.

3. Payment Services

All payments in respect of the Products shall be made to Bigonedigital through the Platform. To the extent permitted by applicable law and subject to Bigonedigital’s Privacy Policy, you acknowledge and agree that Bigonedigital may use certain third-party vendors and service providers, including payment gateways, to process payments and manage payment card information. In order to make payments online, you undertake to use a valid payment card or bank details or third-party wallets or details required for any other mode of payment (“Payment Details”) with the authority to use the same, to have sufficient funds or credit available to complete the payment on the Platform in good standing. By providing the Payment Details, you represent, warrant, and covenant that: You are legally authorized to provide such Payment Details; You are legally authorized to perform payments using such Payment Details; And such action does not violate the terms and conditions applicable to Your use of such Payment Details or applicable law. You agree that You are responsible for any fees charged by Your mobile carrier in connection with Your use of the payment services through Your mobile. Bigonedigital shall use the Payment Details as described in Bigonedigital’s Privacy Policy. You may add, delete, and edit the Payment Details You have provided from time to time through the Platform. The payment receipt for completion of a transaction shall be made available on the Platform and sent to Your email address. Except to the extent otherwise required by applicable law, Bigonedigital is not liable for any payments authorized through the Platform using Your Payment Details. Particularly, TBIL is not liable for any payments that do not complete because: Your payment card or bank account or third party wallet does not contain sufficient funds to complete the transaction or the transaction exceeds the credit limit in respect of the Payment Details provided; You have not provided TBIL with correct Payment Details; Your payment card has expired; or Circumstances beyond BOD’s control (such as, but not limited to, power outages, interruptions of cellular service, or any other interferences from an outside force) prevent the execution of the transaction. The Platform shall not be responsible for any unauthorized transactions conducted on our Platform using Your payment card or internet banking. The Platform shall not be obligated to refund any money to You in such instances. All information that is collected at the time of payment, like card details, names; passwords etc. are encrypted using Secure Socket Layer (SSL) Coding

5. Shipping of Products

Orders placed by You on the Platform are typically processed within 2 (two) business days from the date of purchase. The Products ordered will be delivered to You within 2 (two) – 5 (five) business days. At times when we are experiencing high volume of orders, shipments may get delayed by a few days, in which case, You will be intimated by email or telephone call (on the details shared by You at the time of placing Your order/registering on the Platform).
Once Your order is dispatched, You will receive an e-mail or SMS updating You with the details of the time and progress of the delivery. On the date of delivery, the person delivering the Product will reach out to You (on the number shared by You at the time of placing Your order/registering on the Platform) to confirm Your presence to receive the Order.
You are requested to be available on the date of delivery since the Products will either be hand delivered to You or to someone appointed by You to collect the order on Your behalf.
All deliveries sent to residential or commercial spaces require a receipt signature for authentication. We take no responsibility for shipment receipt signed by an alternative person other than the person ordering the Product or someone appointed by You to receive the order at the delivery address. Maximum of 2 (two) attempts will be made on the date of delivery to deliver the Product at the address indicated as the delivery point, at the time of placing the order post which the order will be cancelled, and Refunds will be made as per the terms and conditions.
We do not take responsibility for an incorrect address that was provided at the time of placing the order. In case of an incorrect address, the product will be returned by the rider and refunds will be made as per the terms and conditions.
All claims for damages must be reported to customer service through an email at: support@bigonemart.com within 24 (twenty four) hours of order delivery.
For each order, a shipment charge will have to be paid by the customer. The exact shipment charges for the order will be shown to the customer at the order checkout page.
As soon as the customer receives the Product, the customer should store it under the storage conditions mentioned on the back of the pack. No replacement or refunds will be done for any quality loss or damages if the Product is not stored in the storage conditions mentioned at the back of the pack.

Cancellation by site / customer, Returns and Exchange

An order once placed and confirmed by the user, it cannot be cancelled by the customer. In an event of delivery agent unable to locate the address due to any unforeseen circumstances, bigonemart online Store may cancel the order, inform the customer, and initiate refund.

Products once delivered are not returnable or exchangeable due to the nature of products

In an event of product/products found to be physically damaged, defective, or different from the description on the detail page, the product amount will be refunded. The customer can raise a complaint and share the supporting images and receipt, or invoice issued at the time of delivery with customer care team to make their claim. The issue needs to be reported within 24 hours from the delivery of the product.

Disclaimer of Warranties & Liability

You expressly understand and agree that, to the maximum extent permitted by applicable law:

Bigonedigital will try to make access to and use of Bigonemart error-free and without interruptions. However, your access to Bigonemart may be occasionally suspended or restricted to allow for repairs, maintenance, or for introduction of new facilities or services on Bigonemart. Bigonedigital does not take responsibility for any access or usage problems that arise from internet related issues at your end.
All information in relation to third parties, including sellers and the products listed by them on Bigonemart (“Third Party Information”) are provided only for reference. Bigonedigital, in its capacity of an intermediary under the applicable laws, is not endorsing Third Party Information and is not responsible for any errors and representation nor is it associated with it and you shall access the Third Party Information at your own risk.
Bigonedigital has made every effort to display as accurately as possible the available Products, including in respect of their colour, size, shape and appearance, as accurately as possible. However, the actual colour, size, shape, and appearance may have variations from the depiction on Your mobile/computer screen.
Bigonedigital will have no liability related to any user content arising under intellectual property rights, libel, privacy, publicity, obscenity, or other laws. BOD also disclaims all liability with respect to the misuse, loss, modification, or unavailability of any user Content.
To help you in identifying the products of your choice, description of the products are provided on Bigonedigital by the relevant seller through photographs, videos, charts, screenshots, infographics and other visual aids. While reasonable efforts are made to provide accurate visual representations, the appearance/color of the products when delivered may differ for various reasons.
The Services included on Bigonemart are provided on an “as is” and “as available” basis without any representations or warranties, express or implied, except as otherwise specified in writing. Reliance does not covenant or provide any representations and warranties:
We respect of quality, suitability, accuracy, reliability, performance, safety, merchantability, fitness for a particular purpose/consumption or the content (including product or pricing information and/or specifications) on Bigonemart;
That the Services will be made available at all times;
That the operation of bigonemart, including the functions contained in any content, information and materials on Bigonemart or any third-party sites or services linked to Bigonemart will be uninterrupted, or that the defects will be rectified, or that Bigonemart or the servers that make such content, information and materials available are free of viruses or other harmful components; and that the Bigonemart Content available on Bigonemart is complete, true, accurate or non-misleading.

CONTENT ON PLATFORM

All information, content, material, text, graphics, images, logos, button icons, software code, interface, design and the collection, arrangement, and assembly of the content on Bigonedigital or any of the other Services are the property of Reliance or its affiliates (“Bigonedigital Content”), and are protected under copyright, trademark, and other applicable laws. Further, all trademarks, services marks, trade names and trade secrets in relation to Bigonemart whether or not displayed on Bigonemart, are proprietary to Bigonedigtal.
Bigonedigital may display on Bigonedigital any third-party logos, trade names, trademarks of other brands, as per the license granted to Reliance by such brands.
No information, content, or material from Bigonedigital (including the Bigonedigital Content) may be copied, reproduced, republished, duplicated, copied, sold, resold, uploaded, posted, transmitted, distributed, or otherwise exploited in any way (including for any commercial purpose) without Reliance’s express written permission. You will not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Reliance and its affiliates without express written consent. You may not use any meta tags or any other “hidden text” utilizing Reliance’s or its affiliates’ names or trademarks without the express written consent of Reliance and/or its affiliates, as applicable. Any unauthorized use terminates the permissions granted in these Terms of Use.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Delhi, India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

1. Next day delivery if ordered before 6 pm is available only in selected pin codes in.

2. Discount cannot be clubbed with any other offer / scheme.

3. If any of the product related to offer is returned, the refund will equal the amount you paid for the product subject to applicable refund policies.

Refund Process

Customer requests for a refund when Order Not Delivered/Item has not delivered/Damaged Item received, then the refund would be considered and processed by Bigonedigital team post validation/inspection.

Refund back into customers bank Account (This will take 4-6 days to reflect in account)

Bigonedigital reserves the right, at its sole discretion on refunds.
